A former nanny, identified in court documents as JK, has filed a lawsuit against Simon Kabu and Sarah Njoki Nyaga, the proprietors of Bonfire Adventures, seeking KSh 21 million in damages. The case, which was filed in the Employment and Labour Relations division of the High Court, accuses the couple of sexual harassment, breach of confidentiality, violation of privacy, and reputational damage. The lawsuit stems from a leaked CCTV recording that went viral on social media, allegedly orchestrated by the Kabus to damage JK’s reputation and deflect attention from their own personal issues.
The legal battle has brought to light previously hidden details about the Kabus personal lives. For years, Simon and Sarah Kabu have portrayed themselves as a successful business couple, but the lawsuit paints a picture of deep marital conflicts, with the nanny caught in the middle. Court documents reveal that JK was hired in June 2024 as a nanny and homeschool teacher for the Kabus’ two children. She was employed under a contract signed with Bonfire Adventures & Events Limited, and her hiring was reportedly part of a plan to manipulate the publics perception of the Kabus.
According to JK, she was hired not just to care for the children but also as a pawn in the Kabus’ ongoing marital struggles. She claims she was subjected to sexual harassment by Sarah Njoki Nyaga, which has formed the basis of her KSh 7 million demand for compensation. Furthermore, she alleges that Simon Kabu breached her confidentiality by leaking CCTV footage of an altercation that occurred between Sarah and herself, leading to an additional KSh 7 million claim.
The incident at the heart of the lawsuit occurred on July 8, 2024, when Sarah returned to the couple’s home in the Edenville gated community on Kiambu Road. Sarah, who had been living separately from Simon at the time, allegedly demanded that JK contact Simon and instruct him to return with their children. After Simon refused to comply, Sarah reportedly fired JK on the spot, ordering her to leave the residence. However, Simon later told JK to remain at her post, which led to further tension the following morning.
According to JK, the confrontation took a violent turn when Sarah allegedly stormed into her bedroom, hurling insults and sexual innuendos. The situation escalated when Sarah is said to have attacked JK with a kitchen knife, causing a deep cut on her arm. After the incident, JK sought medical attention and reported the assault to the police. Investigations began, with the CCTV footage from the house capturing the entire confrontation. However, JK claims that Simon and Sarah deliberately concealed the footage to avoid a public scandal.
As the police investigation proceeded, it was revealed that the footage had been deleted, but JK maintains that Simon and Sarah were involved in efforts to suppress the case. Simon allegedly tried to persuade JK not to pursue criminal charges against Sarah, and law enforcement officers were reportedly involved in trying to push her into an out-of-court settlement. Despite initially pursuing criminal charges, JK was later pressured into accepting a KSh 250,000 settlement, which was deposited into her bank account by Simon on August 28, 2024.
JK now claims that she was coerced into accepting the settlement under duress, pointing out that she was discouraged from seeking legal representation and was urged by law enforcement officers to accept a lower settlement of KSh 100,000. She has alleged that there was systemic bias in favor of Sarah and that she was intimidated throughout the process. Despite assurances that the CCTV footage had been deleted, JK was shocked to find that a video of the violent confrontation had resurfaced on social media on December 4, 2024, sparking further public speculation about her relationship with Simon Kabu.
The leaked footage went viral, fueling online rumors and cyberbullying, with bloggers and social media users allegedly paid by the Kabus to circulate the video. The public spectacle has caused JK significant emotional distress, leading to a loss of friends and family connections, as well as damage to her reputation. In her court filings, she claims that the leak was part of a deliberate attempt by Simon and Sarah to defame her and divert attention from their own marital troubles.
Simon Kabu, in response to JK’s questions about the footage’s release, reportedly claimed that the video had been sent accidentally to a Bonfire Adventures staff WhatsApp group while he was trying to forward it to his lawyer. However, JK disputes this explanation, maintaining that the leak was intentional. She claims that the fallout from the video has led to severe emotional and psychological trauma, including a significant weight loss of more than five kilograms, which she attributes to the distress caused by the leaked footage and subsequent public scrutiny.
The lawsuit has captured significant public attention, revealing the extent of the Kabus troubled marriage and the lengths they may have gone to in order to protect their public image. Legal experts are closely following the case, particularly the issue of whether the Employment and Labour Relations court has jurisdiction over the matter or if Simon Kabu’s application for dismissal will be granted. The case is set to be mentioned before Justice Bernard Matanga next week, and its outcome could have significant implications for the Kabus’ business and public standing.
