High Court Judge Gregory Mutai has directed Inspector General of Police Douglas Kanja, Deputy Inspector General Eliud Lagat, Principal Secretary for Basic Education John Ololtuaa, the Nairobi Director of Education and Senior Deputy County Education Officer Erick Mulevu to personally appear before the court over the delayed implementation of orders on the management of Gatoto Comprehensive School.

The summons followed complaints by petitioners that previous court directives had not been enforced. Represented by Law Society of Kenya President Charles Kanjama and Senior Counsel Martha Karua, the petitioners alleged they faced intimidation while serving the court orders. Kanjama told the court that a vehicle belonging to Karua was stoned by suspected goons, accusing the area OCS of failing to provide adequate security and allowing the vandalism of their vehicles.

The respondents, represented by lawyer Danstan Omari and State Counsel Jacline Kiramana for the Attorney General, opposed the proposed transfer of the school's management. They argued that Gatoto Comprehensive School has been a public institution since the 1990s and warned that changing its management would disrupt learning, affect the administration of Kenya National Examinations Council (KNEC) examinations, and require extensive changes to official education records.

They further maintained that Kenyan law does not currently provide a legal framework for transferring a public school to community management, noting that the relevant legislation is still pending before Parliament.

Justice Mutai ordered the summoned officials to appear in court on July 24 to explain why the earlier court orders have not been implemented.
