Kalonzo Demands Kindiki’s Resignation After Court Blow to Gachagua Impeachment
Wiper leader Kalonzo Musyoka has called on Deputy President Kithure Kindiki to resign following a court ruling that questioned the legality of Rigathi Gachagua’s impeachment. The Court of Appeal ruled that Deputy CJ Mwilu acted unconstitutionally in appointing the bench that handled Gachagua’s case. Kalonzo says the verdict reveals political interference and calls for due legal process.

Wiper Party leader Kalonzo Musyoka has urged Deputy President Kithure Kindiki to resign, claiming Kenya now has "two Deputy Presidents" following a major Court of Appeal ruling that questioned the legality of Rigathi Gachagua’s impeachment process. In a statement issued Sunday, Kalonzo said the courts decision exposed political manipulation and called for Kindiki to step aside to allow proper legal redress.

 The ruling, delivered on May 9, found that Deputy Chief Justice Philomena Mwilu acted outside her powers by forming a judicial bench to handle petitions against Gachagua’s removal while Chief Justice Martha Koome was abroad. The court clarified that only the Chief Justice—regardless of physical presence—holds that constitutional role.

Although the ruling did not reinstate Gachagua, it reset the legal process by returning the petitions to Justice Koome for reassignment. The judges criticized Mwilu’s overreach but rejected calls to disband the current bench, citing lack of bias or misconduct.

 

 Kalonzo’s remarks have intensified political tension within President William Ruto’s administration. As Gachaguas legal team explores further action, the opposition is capitalizing on the court decision to question the legitimacy of Kindiki’s appointment, deepening the uncertainty around Kenya’s deputy presidency.
